Terms & Conditions Of Use

COVID-19 Special Conditions

Please confirm you have read these terms and conditions to proceed with your booking. Any approval of a quotation implies acceptance of these terms and conditions.
You acknowledge and agree that the COVID 19 pandemic has created regulatory responses which include but are not limited to restrictions on travel, gatherings, and events. You agree to:
• Bear the risks associated with current or future restrictions imposed by any competent authority which may impact upon your booking.
• Indemnify us and hold us harmless in respect of any fines, penalties, or costs in connection with any breach of any restriction relating to your occupation of the property.
If your booking is affected by changes to COVID 19 restrictions, please contact us. While we will endeavour to assist you to address any issues, we draw your attention to our reservations and cancellations policy which will apply to your booking.

BOOKING ENQUIRIES

On receipt of the reservation inquiry, we will provide you with a quotation for your approval of our Terms and Conditions, availability, and rate for your stay, including any applicable taxes..
Once approved, an invoice for 50 percent outside of 60 days of arrival will follow for payment unless it is a promotional or reduced offer whereby full payment is required to confirm acceptance.

SECURITY

All events require an outsourced private security presence at $85 per hour. This service will be hired by Tides Byron Estate on the guest’s behalf and billed in addition to the hire venue tariff.
We are also required to register the event on the NSW Police Event Website as per our Council Agreement handed down by the Environmental Court in October 2018, to avoid neighbour complaints.

OUTDOOR DINING

No amplification is allowed outside of the Hall, with acoustic music only in the Orchard and Pre-Dinner Drinks Lawn area. A lightly amplified playlist is allowed to a small speaker, 37 decibels maximum
For outdoor dining arrangements, all equipment must be hired. Tides Byron Estate complimentary dining hire arrangements only extend to internal use within the Hall.
Orchard dining is possible, however, it is not part of our House issue implementation. This includes all Ceremony beverage stations and seating.

CATERING

Pack down fees will be applied by the caterer should the set up exceed the Tides Byron Estate inclusive proposal of up to 120 guests indoors with a dance floor and head table with equipment.
Should the Head Table need to be moved, the cost for the required hydraulic lift will be charged accordingly. The caterer will quote for full service and labour.
Tides Byron Estate is indemnified of issues arising with the Caterer. We are the Landlord and Venue hire only.

BOOKINGS

Event Hall

If the organiser is unable to attend due to a lockdown, a one-time postponement to the nearest available date immediately after the booked date will apply within 3 months of the original booking. This does not cover the inability of invited guests unable to attend.
A second move will incur a 25 percent loading of the event villa and hall rental charges.
A third move will incur in a 50 percent loading of the event villa and hall rental charges.

Event Hall with Accommodation

IIn the event of the bride and groom only being unable to attend due to a lockdown in their state, a one-time postponement can be made to the nearest available date. This does not include the inability of family members or friends unable to attend.
A second move will incur a 25 percent loading of the event villa and hall rental charges.
A third move will incur in a 50 percent loading of the event villa and hall rental charges.

Equipment Hire

The packages available under the Hall Package apply only inside the Hall and Lawn area, not the Fig Tree. Fig Tree ceremonies must be outsourced for equipment hire and pack down plus service.
A laundry charge of $55 per table cloth and $5 per napkin will apply for laundering and replacement if unretrievable through stains.
Please note that no furniture or inclusions extend away from the Hall for the Ceremony Package.
We have 20 permanent chairs available for complimentary use in the Lawn Area. It is agreed that any additional seating must be hired.
The standard agreement applies to standing only with the use of the 20 chairs.

Accommodation Only

Accommodation only bookings are non-refundable.
We will postpone the dates in the event of a Health Order lockdown to the first available and suitable date.
Credit on accommodation stands for 12 months at which time it expires without refund. This does not include Promotion Sales or Offers where full payment is required at the time of sale.

NOISE ABATEMENT

Speeches and celebrations

Under the terms of our Liquor Licence and Neighbourhood Accord, speeches and announcements with a PA system are only permissible in the Hall.
No cheering or noisy celebration is permitted outside of the Hall.

Music

Booking of all musicians and DJs is subject to prior approval.
Only acoustic instruments with minimal amplification are allowed outside the Hall.
The maximum decibel levels outside are 37 db. with the doors always closed.
All musicians catering to a function must be pre-approved by Management.
Drums and Wind instruments are not allowed - max 3 piece band.
Live music must conclude by 7 pm.

Catering and Co-ordinators

All Day Co-ordination must be pre-approved by Management.
All caterers must be pre-approved by Management.

DEPOSIT POLICY

A 50 percent deposit is required at the time of booking. The balance is payable 60 days in advance of the event or arrival.
Failure to pay the balance will result in resale of the dates and cancellation of original booking without refund.
In event of a cancellation after payment, a partial refund may be made if the property is re-booked at the same rate, minus a 20% booking fee.

ALCOHOL AND LIQUOR LICENSE

Responsible Service and Liquor License Accord

All guests that are not in Residence must arrive by Bus and depart at 11.30. The music will be turned off at 11 pm and the Bar will close.
Only residential guests and suppliers may arrive by private vehicle. In a Hall only setting, the Groom, Bride and Bridal Party may arrive by Private Charter.
Tides Byron Estate will not be able to offer packages that exceed 7 hours.

HALL ACCESS

Access to the Events Hall is available from 7 am to 11pm on the date of your booked event.
Under the terms of our Liquor Licence and Neighbourhood Accord, all guests not staying in house must depart Tides Byron Estate by bus by 11.30pm.
Music will finish and the bar closed at 11 pm in all circumstances.
Guests may use the side door to leave the building during service.

CANCELLATION POLICY

In the event of cancellation in all circumstances, the accommodation charge may be wholly forfeited unless we are able to resell the room for the booking dates at the same price.
A partial refund may be made if the property is re-booked at the same rate, minus a 15% booking fee.
In the event of any difference between booking and rebooking fees, charges for rebooking will be calculated at the rates current at the time of the new booking date.
Due to our recent infrastructure improvements, rates for 2022 and beyond are expected to rise by around 25%.

CHECK IN AND OUT TIMES

Due to the size of the property, check in and check out times are strictly enforced to allow sufficient time to carry out cleaning and maintenance checks for safety.
Check out is at 10 am without exception.
Check in time is 3 pm without exception.

SECURITY BOND

We require a $1,500 security bond for villa bookings to cover any loss or damages to the villa and premises which may occur during your stay.
For Event Hall bookings, we require the authorisation of an A$1,500 security bond to cover any rubbish removal fees or cleaning due to an unacceptable state of Kitchen and Hall.
It is the caterer’s responsibility to ensure the Kitchen and Hall is left as found.
